Terms and Conditions: Scotiabank CLUB S Programme

1.     Definitions

·       “Bank" “we”, “us” or “our” means Scotiabank Trinidad and Tobago Limited.

·       “Card” means the Club-S identifier issued to You by the Bank.

·       “Club-S Program” refers to the loyalty program offered by the Bank to qualifying Customers.

·       “Terms” means the terms and conditions of the Club-S Program as set out herein

·       “You” or “Your” or “Member” means the person to whom a Club-S card has been issued by the Bank. The Bank reserves the right to determine criteria for qualifying Club-S customers. The Bank reserves the right to revise these criteria from time to time without notice.

2.     Members of Club-S Program shall receive certain benefits at various participating merchants, preferential product benefits and/or service providers in Trinidad and Tobago. The benefits that Members receive through their membership of the Club-S Program are subject to change from time to time.

3.     These Terms apply to the Program. If You activate, sign or use your Card, it means that you have read these Terms and that You understand and agree to the Terms.

4.     Notwithstanding any other section of the Terms, the posting of the current version of the Terms at tt.scotiabank.com is deemed notice to You of the Terms, where notice is required or permitted to be given hereunder. The Terms are subject to change at any time by the Bank without notice to You.

5.     The Bank may communicate with You regarding any matter related to the Program via mail, via telephone or via electronic communication. All electronic communications to You from the Bank are deemed to be delivered upon the date of posting or dissemination.

6.     The Club-S Card is for your personal and exclusive use and is non-transferable. Benefits will be available only to You.

7.     Merchant benefits and/or discounts shall only be made available to You when you present Your Club- S Card along with a valid form of identification at participating merchants and pay for your goods and/or services using either your debit card or credit card issued by Scotiabank Trinidad and Tobago Limited.

8.     These benefits cannot be negotiated for cash. Benefits cannot be backdated or applied to previous transaction.

9.     The Card remains at all times, the property of the Bank. The Bank reserves its right at any time, and in its absolute discretion to refuse or revoke your membership to the Club-S Program or the benefits associated with the Club-S Program without notice to You.

10.  You are responsible for the care and safety of your Card and You agree to keep your card in a safe place and never let anyone else use it.

11.  You agree to immediately inform the Bank if your Card is lost, stolen or damaged. The Bank shall cover the costs associated with issuing You with a new Card with a new card number.

12.  The Bank reserves the right in its absolute discretion to withdraw, cancel, modify or in any way change at any time, without notice, any benefits previously offered to You. The Bank shall not be liable for any loss or damage resulting from such withdrawal, cancellation or modifications. In the event of such changes, the Bank will endeavor to notify Members.

13.  Benefits offered to Members provided by third parties with which the Bank has agreements, are subject to the terms and conditions of the third parties providing such benefits. You acknowledge and agree that although every effort will be made by the Bank to ensure that the benefits are available, the Bank will not be liable for any loss or damage arising from the provision or non-provision whether in whole or in part, of any such benefits.

14.  The Bank and/or its employees, agents and service providers, may collect, use and share your personal information from time to time for the purposes of enrolment and administration of your participation in the Club-S Program and provision of the benefits and services that You earn with the Club-S Program. Personal information may include information about your debit card, credit card or loyalty program account number, transaction history, or point of sale transaction information. The Bank and/or its employees, agents and service providers may communicate with you about your participation in, or promote and provide information about the benefits, services and rewards of, Club-S Program.

15.  Any waiver by the Bank of the strict observance, performance or compliance by you of any of these Terms and Conditions either expressly or by course of conduct, will not alter, affect or prejudice any of the Bank’s other rights or remedies and will be effective only in the specific instance and for the propose for which it was given, and will not be deemed to be a waiver of any of our rights and remedies for which it was given, and will not be deemed to be a waiver of any of our rights and remedies arising in respect of any other breach of these terms. No delay or omission by us in exercising any right or remedy hereunder will operate as a waiver of that or any other right or remedy.

16.  These terms and conditions are governed by the Laws of the Republic of Trinidad and Tobago.
